A Boston attorney plans to sue the Catholic Church over alleged child molestation by Brooklyn Bishop Nicholas DiMarzio – the man Pope Francis selected last month to oversee sex abuse allegations at the Buffalo Diocese.

Mitchell Garabedian notified Catholic officials in New Jersey he’s preparing a lawsuit on behalf of Mark Matzek, who alleges he was abused by DiMarzio and another priest in Jersey City when he was an altar boy at St. Nicholas Church and a student at the St. Nicholas School in the 1970s, The Associated Press reports.

“The investigation of the diocese of Buffalo by Bishop DiMarzio is tainted because of these allegations,” Garabedian told the AP. “There needs to be a truly neutral investigator to determine whether Bishop Malone should resign.”

Garabedian said police, not Catholic officials, must investigate the situation in Buffalo, where Bishop Richard Malone faces “a true crisis situation” involving a seminarian, Rev. Jeffrey Nowak, pastor of Our Lady Help of Christians Church in Cheektowaga, and Malone’s secretary.

Nowak allegedly violated confessional of the seminarian to pursue a romantic relationship with the man, then launched a smear campaign against him when the seminarian rejected the pastor’s advances. Nowak also alleged a romantic relationship between the seminarian and Malone’s secretary as part of the harassment campaign, though the two claim they’re only friends.

The secretary secretly recorded numerous conversations between Monroe and other top Catholic officials who struggled with what to do about Nowak’s harassment of the seminarian and others, but ultimately did nothing until WKBW published the recordings in August.

Buffalo Diocese officials reportedly did not even discuss the allegations with Nowak.

The tapes suggest Malone lied to his church about when he learned of Nowak’s bad behavior. They also show he broke a vow to handle sexual abuse allegations more transparently after two other similar cases in the last year of reverends who were allowed to continue in ministry despite multiple abuse allegations, according to the news site.

Pope Francis assigned DiMarzio to investigate the mess in Buffalo last month, and he’s already completed his report and sent it to the Vatican, where DiMarzio and Malone are attending a previously scheduled visit with other New York bishops, the AP reports.

“Garbedian said the notice he sent to the Newark Archdiocese briefly describes Matzek’s allegations and the damage he has allegedly suffered, while demanding $20 million in compensation,” according to the new service. “Garabedian told the AP he plans to file the lawsuit on Matzek’s behalf next month, after New Jersey opens a two-year ‘look back’ period in which sex abuse victims will be permitted to file lawsuits without regard to the statute of limitations, which typically limits the amount of time in which an alleged victim may file suit.”

DiMarzio denied any funny business while serving as a parish priest in Jersey City, insisting he has a flawless record of character over five decades in the Catholic Church.

“I am just learning about this allegation,” he said in a statement to the AP Tuesday. “In my nearly 50-year ministry as a priest, I have never engaged kin unlawful or inappropriate behavior and I emphatically deny this allegation. I am confident I will be fully vindicated.”
