An illegal immigrant accused of beating a two-year-old girl so badly police say she’s “lucky to be alive” skipped his court hearing and has gone missing.
Francisco Javier Chavez didn’t show for his arraignment hearing when he was charged with seven felonies stemming from the alleged abuse in Paso Robles, California.
The illegal had been released from police custody when he posted $100,000 bail “before arrangements were made between the county and the Immigration and Customs Enforcement agency to detain him further,” KSBY reports.
“There is nothing we can do until we have him in custody again,” according to Lee Cunningham, San Luis Obispo County Assistant District Attorney. “Hopefully we set that bail so he won’t get out again until we conclude the proceedings and conclude the punishment.”
Shockingly, the sheriff attempted to rationalize the illegal alien’s failure to show for his hearing.
“Is it surprising that there is a warrant and he failed to appear? No. But certainly, being fair, we have plenty of U.S. citizens that do not appear as well and I think the best thing we can do is get him back into custody,” Sheriff Ian Parkinson says. “Now with the increased bail amount, hopefully (we) keep him in custody and (have) him answer to these charges in court.”
It’s not Chavez’s first run in with American law enforcement.
“Since 2006, Chavez has committed several crimes, including assault with a deadly weapon and drug trafficking. He was deported to Mexico in January 2014,” the news station reports.
Meanwhile, an illegal immigrant who made headlines after he was beaten by Santa Ana, California police last year is now in custody and accused of invading several homes.
Police say Edgar Vargas was “under the influence of drugs” earlier this week when he “entered multiple homes” and yards, and “ran through homes stretching across several blocks,” the Voice of OC reports.
He “caused damage to property as well as kept some residents from leaving their house as they were in fear for their safety,” according to a police report.
Vargas reportedly mumbled to a homeowner that someone was trying to “get him.”
It apparently isn’t the feds. Instead, they’re investigating how the Santa Ana police treated him last summer.
The Voice of OC reported last October that the federal government launched a civil rights investigation after video captured police officers pummeling him.
“I can now confirm that we have an investigation open into whether Vargas’ civil rights were violated,” FBI spokeswoman, Ari Dekofsky, said at the time.
Vargas was released from immigration detention because the feds considered him a “material witness” in the investigation.
After Monday’s melee, “Vargas was charged with seven felonies, including burglary, false imprisonment, vandalism and resisting officers. He also faces two misdemeanor counts of vandalism for breaking a window and leaving his blood on walls and furniture,” according to the news outlet.
