An illegal immigrant who had been in the United States less than a year before raping a woman has pleaded guilty to the crime.

Maximino HernandezMaximino Hernandez had been working as a dishwasher at El Tarasco restaurant in Galion, Ohio and had been in the country illegally for 10 months, the Telegraph-Forum reports.

With the guilty plea, Hernandez was sentenced to 10 years in prison. He had been charged with a first-degree felony punishable by up to 11 years in prison and a $20,000 fine.

“I believe justice was done. The victim is extremely happy with the outcome. Even more importantly, this was done without a trial, which protects the victim,” according to assistant county prosecutor Ryan Hoovler.

Hernandez must register as a Tier III sexual offender, which requires “mandatory lifetime reporting to the authorities.”

As for his immigration status, Hoovler said the conviction may result in Hernandez’s deportation.

“But that’s up to the feds,” he says.

Hernandez had previously entered a not guilty plea in June.

“While acknowledging that Hernandez has been in Crawford County illegally, his attorney, Esteban Callejas of Bowling Green, said the defendant’s employment and the fact that he lives with a wife and child in Galion merited lowering a $500,000 bond set last month in Crawford County Municipal Court,” the Telegraph-Forum reported at the time.

“He does not appear to have any prior record of this kind of offense,” Callejas said.

Following Hernandez’s arrest in May, Crawford County Municipal Court Judge Shane Leuthold considered him a flight risk and bond was set at $500,000.

“I don’t believe 10 months represents a significant tie to the community,” the judge said. “He’s a flight risk because he’s not a citizen.”

He set that bond amount “in the interest of protecting the community at large,” the Telegraph-Forum reported at the time.
