A 91-year-old man is behind bars after police say he threatened to execute a landscaper after some grass clippings blew onto the elderly man’s vehicle.

max hortonMax Horton went ballistic during an argument with landscaper Robert Hendrix after some grass clippings were accidentally blown onto Horton’s car, according to a Highlands County Sheriff’s Office arrest report.

Horton allegedly pulled a gun on Hendrix in Avon Park, Florida and ordered him to his knees, 10 News reports. He told Hendrix he was going to kill him.

Another landscaper, Johnny Barnes, “made a move” towards Horton to aid Hendrix, but Horton “fired off a shot toward Hendrix,” according to NBC 5.

As Horton diverted his attention towards Barnes, Hendrix, who later told detectives he was in fear for his life, reached up and was able to disarm Horton.

The two landscapers then tackled the 91-year-old and held him until the deputies arrived.

FCN reports Horton was transported to Highlands Regional Medical Center for treatment after the incident. He could not be treated at Florida Hospital because he has allegedly threatened medical staff with his gun in 2013, “reportedly saying he had a gun in his vehicle and that they would be sorry if he went to get it.”

He is being held without bond and is charged with attempted first-degree murder.
