A Las Vegas motorist who was cut off by two police motorcycles and flipped his middle finger to the officers is now fighting a ticket for improper use of a hand signal.
Kris Luce recorded his interaction with one of the officers who cited him for an expired insurance card and improper use of a hand signal, and the video posted to YouTube is getting a lot of attention, KTNV reports.
“All right sir, under citation, you have two violations,” the officer in the video told Luce from the passenger’s side window. “The first one is signal by hand or arm. Second one is for owner/operator without insurance … your expired insurance card.”
“What is the charge?” Luce replied.
“For flipping you off or giving you the middle finger, like this?” he said, erecting his middle finger for the officer.
“I don’t know why you would want to do that,” said the officer, who is not named in the video or news reports.
“Cause you jumped in front of me, you slammed on both your brakes. Your two bikers. You slammed on your brakes,” Luce said. “Both you and your partner split me one side and the other. In heavy traffic, you slammed on your brakes. I almost ran into you and then I flipped you off and you’re pulling me over for that!”
Luce informs the officer the gesture falls within his right to freedom of speech, and isn’t justification for a citation. The officer counters that Luce stuck his arm out of the window, which is considered a hand signal, though Luce countered that his arm remained within the vehicle.
Luce also gave the officer a piece of his mind.
“You have no right to pull me over for freedom of speech,” Luce told the officer in the video. “Just like I’m going to say f*** the police, f*** you, you’re a piece of sh** cop, you’re fu**** up.”
The cop attempted to argue with Luce, but he wasn’t having it.
“No, that’s fu***** stupid, dude,” he said.
The officer told Luce in the video to contact internal affairs if he wants to pursue a complaint against him before dropping his glasses inside Luce’s vehicle. The officer asks to retrieve them, but Luce refused to allow him to open the door.
“Sir, would you mind if I open your door, my sunglasses fell …,” the officer said.
“No,” Luce replied. “I can get those for you in a second.”
Luce told KTNV he has hired an attorney and plans to fight the tickets.
The Las Vegas Metro Police Department was unavailable to discuss the incident Monday due to the holiday.
Retired Las Vegas Metro officer Randy Sutton, who now serves as the news station’s crime and safety expert, said he believes Luce will win the case.
The video of the incident, posted to YouTube by The Free Thought Project Jan. 16, has garnered about 4,200 views in the days since, as well as a lot of heated comments from viewers.
“U.S. Supreme Court has already ruled that flipping off a cop is freedom of speech,” PaBowHunter wrote.
“Police earning the hate,” Randall Goguen posted.
“Let us know how much money you get,” SmokeDogNY420 added.
