New York City’s Department of Buildings is investigating Donald Trump’s press conference at Trump Tower Tuesday over allegations staff blocked the public from the building in violation of an agreement with the city.
New York City issued Trump a special permit in 1979 to allow the billionaire real estate mogul to expand Trump Tower in exchange for creating a two-story public atrium on the ground floors of the building on Fifth Avenue, which opened in 1983, Reuters reports.
The agreement stipulates that the 6,000 square-foot atrium must remain open to the public between 10 a.m. and 8 p.m. every day, and a sign over the main entrance states as much. But news reports of Trump’s press conference in the atrium on Tuesday morning to discuss donations to veterans groups sparked an investigation into whether Trump violated the agreement by turning the public away, according to CNN.
“Department of Building inspectors will be investigating the allegations that the (public atrium) was closed contrary to the building owner’s agreement with the city,” department spokesman Joe Soldevere told Reuters.
Trump lives in and works from the top floor of Trump Tower. He announced his campaign for president from the atrium last summer, and has used the pink marble lined space for political events and addressing the public throughout the race.
Trump’s agreement with the city allows the Republican presidential candidate to close the atrium for private use up to four times per year with permission from city bureaucrats, but officials contend they “received no such requests” from The Donald, CNN reports.
The Trump Tower is one of several “POPS” – privately owned public spaces – in New York City. The spaces are typically created by developers to preserve public space in dense neighborhoods as a trade off for expanding buildings vertically, Reuters reports.
Michael Cohen, executive with the Trump Organization, disputed allegations Trump Tower was closed to the public Tuesday.
“The property was never closed and I dispute any reports from anybody stating otherwise,” he told Fox News.
The news site pointed out that trump was fined $4,000 last year, and $2,500 in 2006 for installing kiosks in the atrium to sell merchandise.
Austin Finan, spokesman for New York City Mayor Bill de Blasio – a Hillary Clinton supporter, slammed Donald Trump when contacted by CNN about the ongoing atrium investigation.
“Despite what he may think, the rules and laws of this city apply to everybody, including Mr. Trump,” Finan said. “Mr. Trump should honor his agreement with the city to keep the space open to the public.”
At the Tuesday press conference, Trump provided evidence that the Donald J. Trump Foundation gave away $5.6 million to 41 different veterans charities, and Trump himself cut a $1 million check to the Marine Corps – Law Enforcement Foundation, which provides grants to children of fallen marines and federal officers, The Washington Post reports.
